Terms of Use for the Fooz App

1. Introduction

Welcome to the Fooz app ("the App", "we", "us"). By using the App, creating an account or taking part in any of the shows or games inside Fooz, you confirm that you have read these terms, understood them, and agree to be fully bound by them.

If you do not agree to these terms, please do not use the App.

These terms were drafted to comply with the relevant Kuwaiti laws (such as the Electronic Transactions Law, the regulations of the Communication and Information Technology Regulatory Authority, and consumer protection rules), on the basis that Fooz is an entertainment app that is free to play, in which the player pays no money to take part or to receive a result or a prize, and in which nothing for sale in the App affects points, odds or prizes.

Legal note: these terms are a general draft for product purposes and do not replace a specialist legal review under the laws in force in the State of Kuwait.

2. Eligibility and Creating an Account

You must be 18 years of age or older to use the App. If you are below the age of legal majority in Kuwait (currently 21 years), you confirm that you have your guardian's permission to accept these terms.
Using the App requires an account created with a Kuwaiti phone number. We send you a verification code in a text message (SMS) through a licensed Kuwaiti SMS provider, which you enter to sign in.
Each person may have only one account, tied to their phone number. You may not use a phone number you do not own, or let anyone else use your account.
By creating an account, you confirm that all the information you provide is accurate, complete and up to date, and that your nickname and picture are decent and do not impersonate anyone.
To take part in prizes, we may ask you to prove your identity and your residence in the State of Kuwait, in line with local requirements.
We may suspend or close any account if we suspect that the information provided is inaccurate or misleading, or breaches these terms or the applicable laws.
We keep your phone number and your account data as set out on the privacy page.

3. Nature of the Service

Fooz is an entertainment app that offers quiz games and live questions (Quiz Shows) and related features, and it includes a system of points, levels, badges, a daily sign-in streak, a daily wheel and prizes, according to the mechanics set out in these terms and inside the App.
You use the App for entertainment only, and we do not guarantee that you will win any prizes or make any financial return.
The ranking of every show rests on knowledge and speed, and chance plays no part in working out the result of any show. The daily wheel (Section 6) does include an element of chance; it is free, it gives points only, and its odds are shown to the player before every spin. We aim to run the competitions and prizes in line with the Kuwaiti laws governing promotional competitions.
The content of the shows (the questions, the prizes, the ways of winning) may vary from time to time, and we may change, cancel or stop it as we see fit.
Playing Fooz is free. There is no entry fee for any show, there are no random boxes (Loot Boxes) in the App, and nothing for sale in the App affects points, the wheel's odds or prizes.

4. Prohibited Conduct

You are prohibited, by way of example and not limitation, from:

Attempting to cheat or evade the rules, or using any automated or unlawful means to manipulate the results of games, the leaderboard rankings, points or the daily wheel.
Creating more than one account for the same person, using other accounts or phone numbers without their owners' permission, playing on more than one device in a single show, or impersonating another player.
Using the App for any unlawful purpose, or one contrary to public morals, or one that may harm the reputation of Fooz or other users.
Attempting to break into the App's systems, tamper with its security, or gain unauthorised access to the data or accounts of others.

We may suspend or terminate your account immediately, or bar you from playing for a time or for good, if you breach any of the above, without prejudice to any other statutory or contractual rights we have. We may also void your participation in a show in which cheating is established, and take back the points it earned (Section 5).

5. Points

The App offers points that you earn by taking part in shows and answering questions, by signing in each day, through badges, and through the daily wheel. Each account has one total of points, which grows with your activity and goes down only as item 5 of this section provides. We set out how many points each activity earns inside the App and on our website, and it may change from time to time.
These points are different from a show's points, which are the score that decides your rank in a single show and start from zero in every show.
These points have no cash value, and cannot be exchanged for money, prizes or anything else of value; prizes are given according to ranking, as in Section 7, and are not bought with points.
Points may not be transferred, sold or given to another account. Levels, badges and the daily sign-in streak are worked out from your activity in the App, and have no cash value.
If we establish that your participation in a show involved cheating or manipulation, we may void your participation in it and take back all the points you earned from it, including your points in the month's ranking.

6. The Daily Wheel

The daily wheel is a free feature: you are asked for no payment to spin or to get spins, and nothing for sale in the App affects spins, their results or their odds.
Each player gets one spin every day, Kuwait time, and one extra spin for each show they join; the extra spin does not use up the day's spin.
The wheel gives points only, and gives no money and no physical prizes.
The server picks the result of each spin at random, not your device. Before every spin the App shows the possible results and the chance of each, and the odds shown at the time of the spin are the ones that apply to that spin. We may change the possible results and their odds from time to time.
Points from the wheel are added to your total points like any others, and count in the month's ranking mentioned in Section 7.
The prohibited conduct in Section 4 applies to the wheel, and we may void any spin that is established to have resulted from cheating or manipulation and take back its points.

7. Prizes

Prizes are given to the top 3 players in each show, and to the top 3 players by the points they collected in each calendar month, Kuwait time. We announce inside the App and on our website the type of each prize and the conditions for earning it, and these may be changed from time to time.
A show's ranking is set by the players' performance in it, according to the mechanics shown in the App. If players tie for one of the first three places, the better player is the one with, in this order: the most right answers in the final; then the shortest total answer time in the final; then the most points in the main round; then the earliest to join the show; then the lower reference number of the player. We never use a draw or a random selection.
The month's ranking is set by the total points a player earned from the first day of the month to its last day, Kuwait time, from all the activities in Section 5, including the daily wheel. If players tie on points, the one who reached them first comes first.
To be entitled to any prize you must have an account with a Kuwaiti phone number under Section 2, meet the age requirement in it, prove your identity and your residence in the State of Kuwait whenever we ask, and not have breached these terms.
We deliver prizes by hand: we contact the winner directly to arrange delivery, and we may ask for additional documents before delivery.
Prizes are not transferable to another person unless we say otherwise, and may not be exchanged for cash unless the law requires it or we say so expressly.
We reserve the right to cancel or withhold any prize or entitlement if we find that cheating, manipulation or a breach of these terms or of our policies has taken place.
We may deduct or report any taxes or fees due under Kuwaiti law on prizes.
Any objection to the results or the prizes must be submitted within 7 days of the announcement of the result or of the notice of the win.
The contest rules set out in detail how winners are chosen and reached and how prizes are handed over, and are read together with these terms.

8. Availability and Technical Support

We aim to keep the App available and stable as far as possible, but you understand that the service may suffer interruptions, faults or periodic maintenance.
We do not guarantee that the App will be free of errors or always available without interruption.

9. Intellectual Property

All rights in the App, including without limitation the questions, text content, designs, logos, trademarks, interfaces, sounds and videos, are owned by Fooz or by those who license them to us, and are protected under the intellectual property laws in force.
You may not copy, reproduce, modify, translate or publish any part of the App's content without our prior written consent.

10. Disclaimer and Limitation of Liability

The App and its services are provided "as is" and "as available" without any express or implied warranties, including without limitation warranties of fitness for a particular purpose or that the service will be free of interruption or errors.
To the fullest extent permitted by law, we are not liable for any indirect, consequential, special or punitive damages, or for loss of profits, loss of data or interruption of service, or for problems with the network, the internet, service providers or the devices used.
No content inside the App is legal, financial or professional advice.
No waiver or limitation in these terms affects the legal rights that consumers cannot waive under Kuwaiti law.

11. Changes to the Terms

We may amend these terms at any time if the development of the service or the laws in force require it, and we will publish an updated version on this page with the date of the last update.
We may ask for your express consent to some material changes if the law requires it. Your continued use of the App after any update is published is your implied consent to the amended terms.

12. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws in force in the State of Kuwait.
If any dispute arises over the use of the App or these terms, the competent Kuwaiti courts have jurisdiction, subject to any statutory rights you have as a consumer that cannot be limited.
